ProsperQR LLC respects your privacy and is committed to protecting your personal data. This Policy will inform you as to how we look after your personal data, including when you visit our website (regardless of where you visit it from), or when you order or use our services, and tells you about your privacy rights and how the law protects you.
We will never sell your personal data to a third party.
This Policy is provided with links so you can navigate to specific areas set out below. Please also use the Glossary to understand the meaning of some of the terms used in this Policy.
Important Information and Who We Are
Purpose of This Policy
This Policy aims to give you information on how ProsperQR LLC collects and processes your personal data, including through your use of this website, and any data you may provide through this website, or when you contact us or sign up to our newsletters, purchase or order a product or service, or take part in a survey. This includes data related to your Google Business Profile (formerly Google My Business) if you authorize us to access and edit it to provide our services, such as managing reviews via QR codes.
This website is not intended for children under 13 years of age, and we do not knowingly collect data relating to children. If you are a parent or guardian and believe we have collected such data, please contact us.
It is important that you read this Policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This Policy supplements the other notices and is not intended to override them.

The Data We Collect About You
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).
We may collect, use, store, and transfer different kinds of personal data about you which we have grouped together as follows:
Identity Data
First name, last name, username or similar identifier, title.
Contact Data
Billing address, delivery address, email address, telephone numbers, and any social media accounts used to contact us.
Financial Data
Bank account and payment card details.
Transaction Data
Details about payments to and from you and other details of products and services you have purchased from us.
Technical Data
Internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.
Profile Data
Any username and password to access our systems, purchases made by you, your interests, preferences, feedback, and survey responses.
Usage Data
Information about how you use our website, products, and services.
Marketing and Communications Data
Your preferences in receiving marketing from us and any third parties made known to you and your communication preferences.
Business Profile Data
Information from your Google Business Profile (formerly Google My Business), such as business name, address, reviews, photos, or other details, if you authorize us to access and edit it via OAuth or similar mechanisms.
Note: We also collect, use, and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity.
We do not collect any Sensitive Personal Information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data) or any information about criminal convictions and offenses.
How We Use Your Personal Data
We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:
- Where we need to perform the contract we are about to enter into or have entered into with you.
- Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
- Where we need to comply with a legal obligation.
Generally, we do not rely on consent as a legal basis for processing your personal data except for sending you marketing communications via email or text message and for accessing certain third-party integrations like Google Business Profiles. You have the right to withdraw consent to marketing or revoke access to your Google Business Profile at any time by contacting us, by clicking 'unsubscribe' in any communication you receive from us, or through your account settings.

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.
Surveys & Promotional Offers from Us
We may use your Identity, Contact, Technical, Usage, and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services, and offers may be relevant for you (we call this marketing).
We may send you product or service renewal reminders or other communications we are obliged to send under a legal or contractual obligation.
You may receive marketing communications from us if you have requested information from us, purchased goods or services, or provided your details when entering a competition or promotion, in each case, if you have not opted out of receiving that marketing.
Third-Party Marketing
We will get your express opt-in consent before we share your personal data with any third party for marketing purposes.
Opting Out
You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links in any marketing message sent to you or by contacting us at support@prosperqr.com.
Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product/service purchase, product/service experience, or other transactions, or where we need to contact you for contractual or legitimate interest purposes.
For Google Business Profile access, you can revoke our access at any time through your Google account settings or by contacting us. Revoking access may limit certain features of our services.
Do Not Sell or Share My Personal Information (For California Residents)
Under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), California residents have the right to opt out of the "sale" or "sharing" of their personal information. We do not sell your personal data, but we may share it with third parties for cross-context behavioral advertising (e.g., via cookies). To opt out, contact us at support@prosperqr.com or use our website's "Do Not Sell or Share My Personal Information" link (if available). We respond to Global Privacy Control (GPC) signals.
Data Security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors, and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
We have procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
We seek to use third-party technology providers that are ISO 27001 certified or equivalent (e.g., SOC 2) where practical.
Data Retention
How Long Will You Use My Personal Data For?
We will only retain your personal data for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements.
To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process your personal data, and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.
By law, we keep basic information about our customers (including Contact, Identity, Financial, and Transaction Data) for up to 7 years after they cease being customers for tax and legal purposes, but we also keep this information to facilitate repeat purchases. For Business Profile Data, we retain it only as long as your authorization is active or as needed to provide services, typically up to 7 years post-revocation for legal reasons. We will seek to renew consent for marketing communications periodically.

Your Legal Rights
Depending on where you reside, you may have certain rights under applicable privacy laws in relation to your personal data. These may include:
- Request access to your personal data.
- Request correction of your personal data.
- Request deletion of your personal data.
- Object to or limit the processing of your personal data.
- Request portability of your personal data (transfer to you or a third party).
- Right to opt out of sales/sharing (as noted above for CA residents).
- Right to non-discrimination for exercising your rights.
For California residents under CCPA/CPRA, you have additional rights, including to know categories of data collected, sources, and disclosures; to delete data; and to opt out of sales/sharing. We do not use sensitive personal information for inferring characteristics. We do not offer financial incentives tied to data collection.
Similar rights may apply under other state laws (e.g., Colorado CPA, Virginia CDPA). To exercise these rights, please contact us at support@prosperqr.com. We will verify your identity before responding.
No Fee Usually Required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
What We May Need from You
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask for further information in relation to your request to speed up our response.
Time Limit to Respond
We try to respond to all legitimate requests within 30-45 days (depending on applicable law). Occasionally it may take us longer if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Glossary
Internal Third Parties
Other companies in the ProsperQR group acting as joint controllers or processors and who provide IT and system administration services and undertake leadership reporting.
External Third Parties
- Service providers acting as processors who provide IT and system administration services.
- Professional advisers acting as processors or joint controllers including lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance, and accounting services.
- Tax authorities, regulators, and other authorities acting as processors or joint controllers who require reporting of processing activities in certain circumstances.
Your Rights (Detailed)
You may have the right to:
- Request access to your personal data (commonly known as a "data subject access request" or "right to know"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
- Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
- Request deletion of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. Note, however, that we may not always be able to comply with your request for specific legal reasons which will be notified to you, if applicable, at the time of your request.
- Object to or limit the processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
- Request portability of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
- Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
